The Laws That Protect You
These are the actual Nevada laws that protect whistleblowers, explained in plain English.
NRS 281.611 - Definitions
This law defines "improper governmental action" - the kinds of wrongdoing you're protected for reporting:
- Breaking the law: Violations of state or federal law
- Breaking local rules: Violations of city/county ordinances
- Abuse of authority: Using government position for personal gain
- Public danger: Actions creating substantial risk to health or safety
- Wasting money: Gross waste of public funds
This covers ALL government workers in Nevada - state, city, county, and school district employees.
NRS 281.621 - Declaration of Public Policy
Nevada officially declares that the state WANTS you to report corruption:
- Speak up: Nevada encourages disclosure of improper governmental action
- You're protected: If you report in good faith, your rights are protected
- Retaliation prohibited: Your employer can't punish you for reporting
"Good faith" means you honestly believe the wrongdoing happened. You don't have to be 100% right - just honest.
NRS 281.641 - Protection from Retaliation
This is the enforcement law with real teeth. If your employer retaliates within 2 years of your report:
- File an appeal: Request a hearing with the Department of Personnel
- Get investigated: The state holds a hearing to determine if retaliation occurred
- Remedies available: Reinstatement, back pay, restored seniority, clean personnel file
- Who you told doesn't matter: You're protected regardless of whether you reported internally, to media, or to police
The law gives you a path to fight back and win if your employer retaliates.
NRS 281.631 - Your Boss Can't Stop You
No government official can use their authority to prevent you from reporting:
- They CANNOT threaten you to keep quiet
- They CANNOT intimidate you into not reporting
- They CANNOT order you not to report (even as your supervisor)
- They CANNOT use their authority to scare you into silence
If your boss says "Don't report this or you'll be fired" - that threat itself is illegal under Nevada law.
Additional Legal Protections
Nevada OSHA (NRS 618.445)
If you report workplace safety violations in any job (government or private), you're protected from retaliation. Covers unsafe conditions, missing safety equipment, and cover-ups of injuries.
Healthcare Whistleblower (NRS 449.205)
